1. Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and NiyukJobs.ai ("Niyuk Jobs," "Company," "we," "our," or "us"), governing your access to and use of the Niyuk Jobs platform, including our website at www.niyukjobs.ai, mobile applications, APIs, and all related services (collectively, the "Platform").

By creating an account, accessing, or using the Platform in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use our Platform.

2. Definitions

• "Job Seeker" means any individual who uses the Platform to search for, apply to, or explore employment opportunities.
• "Employer" means any company, organisation, recruiter, staffing agency, or individual who uses the Platform to post job listings, search for candidates, or conduct recruitment activities.
• "Content" means all text, data, images, resumes, job listings, profiles, messages, reviews, and other materials uploaded, posted, or transmitted through the Platform.
• "AI Services" means the artificial intelligence and machine learning features of the Platform, including resume parsing, job matching, recommendations, and skill assessments.
• "Premium Services" means any paid features, subscriptions, or add-ons offered through the Platform.

3. Eligibility

To use the Platform, you must:

• Be at least 18 years of age.
• Have the legal capacity to enter into a binding agreement.
• Not be barred from using the Platform under any applicable laws.
• If registering on behalf of an organisation, have the authority to bind that organisation to these Terms.

By using the Platform, you represent and warrant that you meet all the above eligibility requirements.

4. Account Registration & Security

4.1 Account Creation

To access certain features, you must register for an account by providing accurate, current, and complete information. You agree to update your information promptly to keep it accurate.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Create a strong, unique password for your account.
• Not share your login credentials with any third party.
• Notify us immediately at sales@niyukjobs.ai if you suspect any unauthorised access to your account.

We are not liable for any loss or damage arising from your failure to protect your account credentials.

4.3 One Account Per User

Each individual may maintain only one personal account. Employers may maintain one organisational account with multiple authorised users. Creating duplicate or fake accounts is strictly prohibited.

5. Platform Services

Niyuk Jobs provides an AI-powered recruitment platform that offers the following services:

• Job search, discovery, and application tools for job seekers.
• Job posting, candidate search, and applicant management tools for employers.
• AI-powered resume parsing, job matching, and recommendation features.
• Communication tools for connecting job seekers with employers.
• Career resources, insights, and analytics.
• Premium features and subscription plans for enhanced functionality.

We reserve the right to modify, suspend, or discontinue any feature or service at any time, with or without notice.

6. Job Seeker Terms

6.1 Profile & Resume

By creating a job seeker profile and uploading your resume, you agree that:

• All information provided is accurate, truthful, and not misleading.
• You grant Niyuk Jobs the right to process, parse, store, and display your profile and resume to potential employers in connection with the Platform's services.
• You are solely responsible for the content of your profile and resume.

6.2 Job Applications

When you apply for a job through the Platform, your application and relevant profile information will be shared with the respective employer. Niyuk Jobs does not guarantee that you will receive a response, interview, or job offer from any employer.

6.3 Profile Visibility

You may control the visibility of your profile through your account settings. If you set your profile to "searchable," employers may find and view your profile through our candidate search tools.

7. Employer Terms

7.1 Job Listings

Employers agree that all job listings posted on the Platform shall:

• Represent genuine, current employment opportunities.
• Comply with all applicable labour laws, anti-discrimination regulations, and employment standards.
• Not contain misleading, false, or deceptive information about the role, compensation, or company.
• Not require applicants to pay fees as a condition of employment.
• Not be used for any illegal, fraudulent, or exploitative purposes.

7.2 Use of Candidate Data

Employers agree to use candidate information received through the Platform solely for legitimate recruitment purposes. Employers shall not:

• Share, sell, or distribute candidate data to third parties without consent.
• Use candidate data for marketing, spam, or purposes unrelated to recruitment.
• Discriminate against candidates based on protected characteristics.

7.3 Hiring Decisions

All hiring decisions are made solely by employers. Niyuk Jobs is not a party to any employment relationship and bears no responsibility for hiring outcomes, workplace conditions, or employer-employee disputes.

8. AI-Powered Services

8.1 Nature of AI Services

Our Platform uses artificial intelligence and machine learning to provide features including resume parsing, job matching, candidate recommendations, and skill assessments. You acknowledge that:

• AI-generated recommendations and matches are suggestive and not guarantees of suitability or outcomes.
• AI algorithms may occasionally produce inaccurate, incomplete, or biased results.
• We continuously work to improve the accuracy and fairness of our AI systems.

8.2 No Automated Decision-Making

Our AI services are designed to assist — not replace — human decision-making. No final employment decisions (hiring, rejection, or otherwise) are made solely by automated means through our Platform.

8.3 Data Usage for AI

By using the Platform, you consent to your data being processed by our AI systems for the purposes described in our Privacy Policy. We use aggregated and anonymised data to train and improve our algorithms.

9. Prohibited Conduct

You agree not to engage in any of the following activities while using the Platform:

• Posting false, fraudulent, misleading, or defamatory content.
• Impersonating another person or entity.
• Scraping, crawling, or using automated tools to extract data from the Platform without prior written consent.
• Attempting to gain unauthorised access to accounts, systems, or networks connected to the Platform.
• Uploading viruses, malware, or any harmful code.
• Using the Platform for spamming, phishing, or unsolicited advertising.
• Engaging in any form of harassment, discrimination, or hate speech.
• Posting job listings for illegal, immoral, or non-existent positions.
• Circumventing or interfering with the Platform's security features.
• Violating any applicable local, state, national, or international laws or regulations.
• Reselling, sublicensing, or commercialising access to the Platform without authorisation.

10. Intellectual Property

10.1 Our Intellectual Property

The Platform, including its design, logos, branding, software, algorithms, AI models, text, graphics, and all related intellectual property, is owned by or licensed to Niyuk Jobs and is protected by applicable copyright, trademark, and other intellectual property laws. You may not reproduce, modify, distribute, or create derivative works based on any portion of our Platform without our express written permission.

10.2 Your Content

You retain ownership of the content you upload to the Platform (such as resumes, job listings, and profile information). By uploading content, you grant Niyuk Jobs a worldwide, non-exclusive, royalty-free licence to use, process, display, reproduce, and distribute your content as necessary to provide and improve our services.

10.3 Feedback

Any feedback, suggestions, or ideas you provide to us about the Platform may be used by Niyuk Jobs without restriction or compensation to you.

11. Payment & Subscriptions

11.1 Premium Services

Certain features of the Platform may require payment. Fees for Premium Services are displayed at the time of purchase and are subject to change with prior notice.

11.2 Billing & Renewal

Subscription-based services will automatically renew at the end of each billing cycle unless you cancel before the renewal date. You authorise us to charge the applicable fees to your designated payment method.

11.3 Refund Policy

Payments are generally non-refundable unless otherwise stated at the time of purchase or required by applicable law. If you believe you are entitled to a refund, please contact us at sales@niyukjobs.ai.

11.4 Taxes

All fees are exclusive of applicable taxes (including GST) unless stated otherwise. You are responsible for paying all taxes associated with your use of Premium Services.

12. Disclaimers

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, NIYUK JOBS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Specifically, we do not warrant that:

• The Platform will be uninterrupted, error-free, or secure.
• The results obtained from the Platform (including AI recommendations) will be accurate or reliable.
• Any job listing, employer, or candidate on the Platform is legitimate, qualified, or trustworthy.
• The Platform will meet your specific requirements or expectations.

You use the Platform at your own risk. We strongly recommend that both job seekers and employers exercise due diligence and independent judgment when using the Platform.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NIYUK JOBS AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, data, or business opportunities.
• Costs of procuring substitute services.
• Damages arising from hiring decisions, employment disputes, or workplace issues.
• Damages resulting from errors in AI-generated recommendations or matches.
• Damages caused by unauthorised access to or alteration of your data.

In no event shall our total aggregate liability exceed the amount you have paid to us in the twelve (12) months preceding the claim, or INR 10,000, whichever is greater.

14. Indemnification

You agree to indemnify, defend, and hold harmless Niyuk Jobs and its directors, officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:

• Your use of the Platform or violation of these Terms.
• Content you upload, post, or transmit through the Platform.
• Your violation of any rights of another person or entity.
• Your violation of any applicable law or regulation.

15. Termination

15.1 By You

You may terminate your account at any time by contacting us or through your account settings. Upon termination, your right to use the Platform ceases immediately.

15.2 By Us

We may suspend or terminate your account at our sole discretion, with or without notice, for any reason, including but not limited to violation of these Terms, fraudulent activity, or inactivity.

15.3 Effect of Termination

Upon termination, the following provisions survive: Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law. We will handle your data in accordance with our Privacy Policy.

16. Governing Law & Dispute Resolution

16.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

16.2 Dispute Resolution

Any dispute arising out of or in connection with these Terms shall be resolved as follows:

• Amicable Resolution: The parties shall first attempt to resolve the dispute through good-faith negotiation within 30 days of written notice.
• Arbitration: If negotiation fails, the dispute shall be referred to and resolved by binding arbitration under the Arbitration and Conciliation Act, 1996 of India, conducted in English.
• Jurisdiction: The courts of India shall have exclusive jurisdiction over any matters not subject to arbitration.

17. Changes to These Terms

We reserve the right to modify or replace these Terms at any time. When we make material changes, we will update the "Last Updated" date and notify users through the Platform or via email. Your continued use of the Platform after any changes constitutes your acceptance of the revised Terms.
